Government improves rules for engaging advisers in preparing PPP projects

The Cabinet of Ministers of Ukraine has updated the procedure for engaging advisers in preparing public-private partnership (PPP) projects, including concessions. The amendments to Resolution No. 950 will help prevent conflicts of interest, make the selection of advisers more transparent and set clearer terms for paying for their services. The Government adopted the decision at its meeting on October 28, 2026.

Under the new rules, the following persons cannot serve as advisers:

  • members of the tender committee for the same project;
  • persons with ties to aggressor or occupying states;
  • persons in an employment or contractual relationship with potential private partners or tender participants.

Payment for an adviser’s services will consist of a fixed amount and, under certain conditions, an additional variable portion, which may be paid by the private partner. This portion may not exceed 2% of the project’s value. The total payment for advisers’ services on a single project is capped at 7% of its expected value: 2% for identifying parties interested in participating in the tender, up to 2.5% for preparing the concept note and/or feasibility study, and up to 2.5% for preparing the draft tender documentation. Maximum payment amounts have also been set for individual services.

Candidates will also be selected with regard to their skills in financial modeling and in preparing feasibility studies and concept notes.

In addition, project preparation can now be financed with the participation of international financial institutions and donors. Agreements with them will be concluded through direct negotiations.
