Government updates e-notary regulations
The Cabinet of Ministers of Ukraine adopted a resolution, developed by the Ministry of Justice, amending resolutions No. 1290 of 9 December 2021 and No. 619 of 30 May 2024.
The resolution aims to align regulatory provisions, ensuring proper legal regulation of the Electronic Register of Notarial Actions and the use of special notarial document forms.
The resolution “On Amendments to Cabinet of Ministers Resolutions No. 1290 of 9 December 2021 and No. 619 of 30 May 2024” includes:
- Standardising the simultaneous maintenance by notaries of the Electronic Register of Notarial Actions and paper registers during an experimental project;
- Regulating access to the Electronic Register’s data during the reorganisation of state notary offices, including transferring access to successors;
- Clarifying data not entered into the Electronic Register but recorded in paper registers, as per Notarial Record-Keeping Rules (e.g., fees for notarial actions, state duty exemptions, and signatures of applicants);
- Authorising the designated administrator of the Unified Register of Special Notarial Document Forms to record details of destroyed, lost, stolen, or undelivered forms (to state notary offices, archives, or private notaries).
The resolution aligns regulatory provisions, streamlines related processes, prevents inconsistencies in practice, ensures the effective operation of the Electronic Register of Notarial Actions within the Unified State e-Notary System, and enhances the accounting and control of special notarial document forms.
