
Yuliia Svyrydenko: We continue to reform the government regulation sector
We continue to clean up the regulatory framework from outdated and redundant state regulation instruments. On March 21, the Government approved a draft Presidential Decree on the repeal of certain decrees that had previously introduced state regulation instruments.
The decisions will come into force after the President signs the draft proposed by the Government. The instruments to be cancelled have been previously analysed and recommended for abolition by the Interagency Working Group (IWG) on Accelerated Review of State Regulatory Instruments for Economic Activity.
"We continue to clean out the 'Augean Stables' of state regulation. Some of the tools that both the authorities and businesses are still forced to use have almost been around since the Soviet era. The "temporary regulations" adopted in the early 1990s, when neither a market economy nor a relevant regulatory framework existed, are still in force. It is obvious that such instruments have long since lost their relevance, do not fulfil the functions intended when they were introduced, and only take time away from business, complicate work and slow down economic processes. That is why we will cancel them," said Yuliia Svyrydenko, First Deputy Prime Minister and Minister of Economy, Co-Chair of the IWG on Deregulation.
Thus, the draft Decree of the President of Ukraine adopted by the Government proposes to invalidate the Decree of the President of Ukraine No. 479/92 "On the Temporary Regulation on Legal Protection of Industrial Property Objects and Rationalisation Proposals in Ukraine". The Decree itself was adopted in 1992 on the basis of the provisions of the 1978 Soviet-era Constitution of Ukraine. Already in 1994, another Presidential Decree cancelled a significant part of the provisions of the Interim Regulations in connection with the adoption of the Laws of Ukraine "On Protection of Rights to Inventions and Utility Models", "On Protection of Rights to Industrial Designs", and "On Protection of Rights to Trademarks and Service Marks". Therefore, the remaining provisions are still used, in particular, by government agencies when making decisions. For example, the Regulation on Patent Licensing, Inventive and Innovative Work in the System of the Ministry of Defence of Ukraine, approved last autumn, refers to the Temporary Regulation.
The draft Decree also proposes to invalidate Presidential Decree No. 240/2012 "Certain Issues of Re-export of Goods". The decision was made in accordance with Article 197 of the Customs Code of Ukraine of 2002. Therefore, the latter became invalid with the entry into force of the new Customs Code adopted in 2012.
If approved by the President, the Draft Decree will abolish such instruments as the Certificate for Rationalisation Proposals and the Permit for Re-export of Goods Originating from Other Countries.
