  • The decision of the President of Ukraine to veto the Law on the restoration of competitions for public service posts seeks to prevent blocking the work of the ministries

    The Cabinet of Ministers of Ukraine supports the decision of the President of Ukraine Volodymyr Zelenskyy to return the law "On Amendments to Certain Laws of Ukraine Regarding the Resumption of Competitions for Holding Civil Service Positions and Other Issues in Civil Service" to the Verkhovna Rada due to the need to finalize it because the current version of the law can lead to the blocking of the work of ministries headed by acting ministers.

    In particular, some provisions concerning the performance by the First Deputy Minister or Deputy Ministers of only certain powers of the Minister are unacceptable, since they violate the constitutional provisions on appointment on the proposal of the Prime Minister members of the Government.

    An important reason for returning the Law for further finalizing is that the inability of the First Deputy Minister and Deputy Ministers to perform the duties of the Minister during the period when the post of minister is vacant prevents the relevant ministry from fulfilling its powers and violates the principle of continuity of state power.

    Moreover, the adoption by the Parliament of a norm prohibiting the acting minister to hold office as a minister if the minister's position is vacant for more than 60 days is an interference in the work of the Government, as according to Article 116 (1) of the Constitution of Ukraine domestic and foreign policy of the state, implementation of the Constitution and laws of Ukraine and decrees of the President of Ukraine.
