
Cabinet of Ministers appoints acting chairman and board members of Ukrzaliznytsia
On October 25, the Government dismissed members of the Ukrzaliznytsia management board Ivan Yurik and Frantisek Bures. Instead, the Government appointed Olexandr Kamyshin as chairman of the board and members of the board Hryhorii Boyko, Orest Logunov, Yevhen Lyashchenko, Olexandr Pertsovsky, and Roman Chernitskyy.
As the powers of the majority of members of the Supervisory Board of JSC Ukrzaliznytsia have been terminated, the management of the enterprise, in accordance with its Charter, is entrusted to the general meeting of the joint-stock company, whose functions are performed by the Cabinet of Ministers of Ukraine. Given the termination of the powers of the majority of members of the Supervisory Board, the uncertain position of the joint-stock company could pose a threat to the national security of Ukraine.
Thus, the Cabinet of Ministers of Ukraine acted on the basis, within the powers and in the manner prescribed by the Constitution and laws of Ukraine, in particular, the Commercial Code of Ukraine, the Law of Ukraine "On the Cabinet of Ministers of Ukraine", the Law of Ukraine "On Joint Stock Companies" On the peculiarities of the formation of a joint-stock company of public railway transport ", etc.
According to the Law of Ukraine “On Management of Objects of State-Owned Property,” the Cabinet of Ministers of Ukraine may appoint and dismiss heads of economic entities in respect of which management functions are performed by the Government.
The appointment of the chairman and members of the board is temporary - until the election of members of the supervisory board of JSC "Ukrzaliznytsia" and no more than December 31, 2021.
