  • Olha Onishchuk: Draft law No. 1056-1 adopted by the VR as whole offers a number of efficient anti-raidership preventing mechanisms

    Last week, we obtained new tools to fight raidership. The Verkhovna Rada adopted as whole Bill No. 1056-1 "On amendments to certain legislative acts of Ukraine on the protection of property rights", which stipulates the establishment of a number of effective anti-raidership protecting tools. Deputy Minister of Justice of Ukraine for State Registration Issues Olha Onishchuk commented.

    “The law passed by the Parliament excludes accredited entities from among the entities exercising powers in the field of state registration. Moreover, liability for violations in this area has been increased. In particular, the document stipulates that the CMU determines the criteria by which the degree of responsibility for relevant violations committed in the field of state registration, which would significantly reduce corruption risks in the sphere of control”, Olha Onishchuk informed.

    She noted that, among other things, the Law sets out the obligation of the registrar to determine the volume of civil capacity of individuals as well as the civil legal capacity and capacity of legal entities, as also to check the authority of a representative of a natural or legal person to take actions aimed at acquiring, changing or terminating of property rights, encumbrance of such rights in case of registration of rights not as a result of notarial act.

    “Besides, additional protection of notarized copies of documents, on the basis of which state registration is conducted, has been established by printing them as a special types of notarized documents, while the access of the state registrar to the state registers will be carried out through multifactor authentication, thereby providing protection against unauthorized access to registers”, said the Deputy Minister of Justice.
