  • Interagency Working Group on Deregulation revises more than half of the state regulatory instruments of central authorities

    More than a tenth of the state regulatory instruments within the competence of the National Commission for the State Regulation of Electronic Communications, Radio Frequency Spectrum and the Provision of Postal Services and the State Service for Special Communications and Information Protection should be cancelled, while the remaining instruments should be modernised. This decision was made by the Interagency Working Group on Deregulation following an analysis of the instruments managed by these government agencies at a meeting on 20 April 2023.

    Thus, by unanimous decision, the IWG recommended cancelling all three instruments provided for in the Regulation on the Procedure for Forming the Identification Code Space of the Ukrainian Segment of the World Object Identifier Space:

    • notification on the use of the object identifier assigned by the National Registration Organisation for Object Identifiers in Ukraine;
    • registration certificate of assignment of an object identifier;
    • determination of organisations performing the functions of national registration organisations authorised to manage and administer the Ukrainian segment of the global object identifier space.

    These tools are not provided for in the current Law On Electronic Communications or any other law and are not used in practice.

    It was also recommended to cancel, in particular, the Permit for the Importation of Radio Electronic Equipment and Radiating Devices from Abroad to Ukraine and the Permit for the Sale of Radio Electronic Equipment and Radiating Devices in Ukraine. As noted during the meeting, these instruments are also not provided for by the Law On Electronic Communications and are not used in practice.

    A number of instruments were recommended to be simplified, digitised, etc., and some to be switched to the notification principle. For example, it is proposed the following:

    • to introduce a notification principle for licences instead of licensing;
    • for conducting economic activities to assess the security of information that does not constitute a national secret;
    • to carry out economic activities on assessing the security of information of all types, including information that constitutes a national secret;
    • to carry out economic activity on detection of burglary devices;
    • to carry out economic activities for the development and preparation of design and other technical documentation, production of cryptosystems and means of cryptographic protection of information, etc.

    "The Interagency Group has passed a certain stage of its work, a kind of "equator": we have reviewed more than half of the instruments dealt with by central executive authorities. About a third of the revised instruments should be cancelled, while the rest need to be re-engineered, simplified and digitalised. We are moving forward," said Yuliia Svyrydenko, First Deputy Prime Minister of Ukraine, Minister of Economy of Ukraine and Co-Chair of IWG on Deregulation, following the meeting.

    The Interagency Working Group on the Accelerated Review of State Regulation of Economic Activity was established by the Government on 13 January 2023. The IWG is headed by Yuliia Svyrydenko, First Deputy Prime Minister and Minister of Economy of Ukraine, and Mykhailo Fedorov, Deputy Prime Minister and Minister of Digital Transformation of Ukraine.

    The working group includes representatives of the ministries of Economy, Digital Transformation, Environmental Protection and Natural Resources, Justice, Finance, and Regulatory Service. Experts from the Better Regulation Delivery Office are also involved in the work of the IWG.
