Government approves procedures for practical support of employment for persons with disabilities
The Cabinet of Ministers of Ukraine has approved two procedures required to implement updated legislation on the right of persons with disabilities to work. The decisions concern monitoring employers’ compliance with workplace quotas, as well as assessing employers eligible for benefits for creating jobs for persons with disabilities.
The documents were developed in implementation of Law of Ukraine No. 4219-IX on ensuring the right of persons with disabilities to work. The law updated approaches to the employment of persons with disabilities, while the procedures approved by the Government define how these provisions will operate in practice.
“Barrier-free access in the labour market means that a person with a disability has not only a formal right to work, but also a real opportunity to find employment, work in appropriate conditions and fulfil their professional potential. To achieve this, the state must establish clear rules, while employers need a transparent mechanism for complying with them. The approved procedures will help make support for the employment of persons with disabilities more transparent, targeted and practical,” said Minister of Economy, Environment and Agriculture of Ukraine Oleksii Sobolev.
The first procedure establishes the mechanism for monitoring compliance with workplace quotas for employing persons with disabilities. This will ensure uniform application of legal requirements, improve the effectiveness of state oversight and eliminate legal uncertainty in this area. For employers, this means a clear process and transparent criteria for assessing compliance.
To support businesses and ensure a smooth transition to the new inspection procedures, state supervision measures regarding compliance with workplace quotas for persons with disabilities will apply only to the period starting from 1 July 2026. This will provide employers with additional time to adapt to the updated requirements.
The second procedure concerns employers creating jobs for persons with disabilities who may qualify for relevant benefits. The document defines how compliance with eligibility criteria will be assessed and how conclusions on compliance will be issued.
This applies in particular to enterprises and entrepreneurs focused on labour integration of persons with disabilities, as well as sheltered employment enterprises engaged in non-commercial economic activities. Following the assessment, employers may receive a conclusion confirming compliance with the established criteria. Such a conclusion is important for obtaining or losing the relevant status and for applying the benefits provided by law.
The aim of these decisions is to make support more targeted. Benefits should go to employers who not only formally declare the employment of persons with disabilities, but genuinely create jobs for them, ensure proper working conditions and comply with legal requirements.
The approved procedures are expected to contribute to:
- increasing the employment rate of persons with disabilities;
- creating more jobs for persons with disabilities;
- establishing clearer rules for employers;
- ensuring transparent application of tax and fee benefits;
- improving state oversight of workplace quota compliance;
- developing a more barrier-free and inclusive labour market.
