Government establishes uniform rules for evaluating bids in public procurement

The Cabinet of Ministers of Ukraine has approved amendments to the public procurement rules aimed at establishing a uniform approach to evaluating bids from participants/suppliers in the electronic catalogue (both residents and non-residents).
Bids from participants/suppliers in the electronic catalogue will be stated excluding value added tax. Accordingly, evaluation of bids will also take place without including VAT, which will neutralise the impact of different taxation systems on evaluation outcomes.
Key changes:
- Fair comparison – The Prozorro system will compare all participants’ prices “net”, excluding taxes. This will enable the selection of the truly most economically advantageous bid.
- Transparency of announcements – Expected procurement costs in announcements will be indicated by contracting authorities without VAT, making tender conditions clear to all participants, including foreign companies.
- Preservation of business rights – Non-VAT payers will continue to participate freely in tenders. If the winner is a VAT payer, the tax amount will be added to the contract price as required by law.
To allow businesses and the procurement sector to prepare for the new rules, they will take effect from 1 July 2026.
