Regulation of artificial intelligence in Ukraine: Ministry of Digital Transformation presents White Paper

The White Paper describes in detail the approach to the regulation of artificial intelligence in Ukraine.

The document will help companies understand how to prepare for future AI legislation and create products that are safe for citizens.

The developed approach takes into account the interests of all key stakeholders – citizens, businesses and the state. The main goal is to protect the rights of Ukrainians without stopping the development of innovations. This approach will help Ukrainian companies become more competitive and enter international markets. For the state, this is an opportunity to integrate into the EU by synchronising its AI legislation with the European one.

“Any abrupt moves in terms of innovations can slow down the development of the industry. That is why we have chosen a soft approach to the establishment of regulation in Ukraine, which will be based on the bottom-up principle: first, we prepare companies for the requirements, and then adopt a law analogous to the European AI Act.

At the first preparatory stage, businesses will receive tools from the state that will help them prepare for the future legislation in advance,” said Deputy Minister of Digital Transformation Oleksandr Bornyakov.

The tools that the state will provide to companies include general and sectoral recommendations for various areas and aspects of AI use: from education and journalism to advice on personal data processing. In addition to the recommendations, it is planned to create voluntary codes of conduct, a legal assistance platform for businesses, a regulatory sandbox for testing high-tech products for compliance with future requirements, etc.
