  • Deregulation: Government abolishes outdated instruments

    The Cabinet of Ministers of Ukraine has amended a number of resolutions as part of its economic deregulation efforts. Following the recommendations of the Interagency Working Group on Accelerated Review of State Regulation of Economic Activity, the Government, by its decision approved at a meeting on March 17, 2023, has abolished certain outdated instruments.

    “The analysis carried out by the IWG on deregulation shows that today there are many valid but outdated instruments in the regulatory field. Some of them even have a soviet background. Ultimately, they simply have no practical value today, are not used, or are used to a very limited extent. We will gradually abolish all such instruments that only clog the regulatory field,” said Yuliia Svyrydenko, First Deputy Prime Minister and Minister of Economy of Ukraine.

    Thus, the Government’s decision canceled:

    • issuance of control stamps for distribution of copies of audiovisual works, phonograms, videograms, computer programs, and databases. This refers to holograms on CDs, without which retail sales of CDs were prohibited.
    • conclusion of a research organization on the technical impossibility of neutralizing and disposing of harmful substances, production waste, and wastewater.
    • the conclusion that the goods used to develop the production and consumption of biofuels are not produced and have no analogues in Ukraine. As noted during the consideration of the issue by the Interagency Working Group, this instrument is also currently outdated and inactive.

    By its decision, the Government also transferred the powers to issue a certificate of an intellectual property representative (patent attorney) to the National Intellectual Property Authority. Until now, these powers belonged to the Ministry of Economy, while according to the law, the functions of certification and registration of patent attorneys are performed by the National Intellectual Property Authority.
