According to the decision of the Cabinet of Ministers of Ukraine, from January 1, 2023, the list of state bodies authorized to affix the Apostille stamp on official documents issued by Ukrainian authorities and intended for use in foreign countries is expanded.

The Ministry of the Interior, the State Migration Service and the State Tax Service have the authority to affix an Apostille on documents within their competence. At the same time, the types of documents that will continue to be certified by the Ministry of Foreign Affairs, the Ministry of Justice and the Ministry of Education and Science are clarified.

The new procedure will allow to comprehensively improve the official certification of documents to be used outside Ukraine, optimize the procedure for providing services to individuals and legal entities in this area, minimize logistical difficulties, time and financial costs of applicants who can apply for documents to be authenticated in specialized bodies.

Thus, from next year the documents will be apostilled by the following bodies:

Ministry of Internal Affairs of Ukraine - on documents issued by the Ministry of Internal Affairs and its territorial bodies for the provision of services, except for documents relating to education and science;

Ministry of Education and Science of Ukraine - on documents issued by the Ministry of Education and Science, central executive bodies, whose activities are directed and coordinated by the Cabinet of Ministers, their territorial bodies, educational institutions, enterprises, institutions and organizations providing services in education and science or other activities related to the provision of such services;

Ministry of Justice of Ukraine - on documents issued by justice bodies, courts, state archival institutions, penitentiary and probation bodies, as well as on documents issued by notaries;

State Migration Service - on documents issued by the SMS, its territorial bodies and territorial subdivisions related to the field of migration (immigration and emigration), including combating illegal (illegal) migration, citizenship, refugees and other statutory categories of migrants;

State Tax Service of Ukraine - on documents issued by the State Tax Service and its territorial bodies;

Ministry of Foreign Affairs of Ukraine - on all other types of documents.

Background

The documents are apostilled in accordance with the 1961 Convention Abolishing the Requirement of Legalization for Foreign Public Documents.
