At its meeting on 7 January 2025, the Cabinet of Ministers of Ukraine, at the initiative of the Ministry of Internal Affairs, has approved a resolution on the extension of the temporary certificate of a citizen of Ukraine during martial law for foreign citizens from the russian federation and the republic of belarus who participate in the defence of Ukraine. The marks on the extension of the temporary certificate of a citizen of Ukraine will be made by the territorial bodies of the State Migration Service, diplomatic missions or consular offices.
The resolution was adopted to implement paragraph 5 of Section II of the Final and Transitional Provisions of Law of Ukraine No. 3897-IX "On Amendments to Certain Laws of Ukraine on the Legal Status of Foreigners and Stateless Persons Participating in the Protection of the Territorial Integrity and Inviolability of Ukraine". This clause provides that citizens of the Russian Federation and the Republic of Belarus who acquired Ukrainian citizenship from 24 February 2020 and submitted an obligation to terminate their foreign citizenship are required to submit a document on the termination of their foreign citizenship within 12 months from the date of termination or cancellation of martial law in Ukraine.
Under the current legislation, a temporary certificate of a citizen of Ukraine is issued for a period of up to 2 years. There was no provision for extending the validity of this document. In this regard, the Government issued a decree regulating the validity of temporary Ukrainian citizenship certificates under martial law for citizens of the russian federation and the republic of belarus who, since February 2020, have acquired Ukrainian citizenship in accordance with the current legislation and have submitted an obligation to terminate their foreign citizenship within two years of acquiring Ukrainian citizenship and the term for fulfilling such an obligation has expired.
The territorial bodies of the State Migration Service, diplomatic missions or consular offices of Ukraine may now make a note in the temporary certificate of a citizen of Ukraine to extend its validity.
Recently, the Cabinet of Ministers adopted a draft decree amending the list of administrative services provided by executive authorities and CASPs. According to this order, the issuance of a foreign passport and a passport of a citizen of Ukraine may be carried out simultaneously.
