The Verkhovna Rada of Ukraine has adopted the draft law "On recording information on damage caused to the personal non-pecuniary rights of individuals as a result of the armed aggression of the russian federation against Ukraine".
This legislative initiative introduces a system of accounting for non-pecuniary damage, an important tool for recording cases of loss of life, health, family, forced displacement, or deprivation of access to education and medicine due to the war. It also regulates the establishment and operation of the Register of Data on Children Deported or Forcibly Displaced as a Result of russia's Armed Aggression against Ukraine.
Ukraine is experiencing unprecedented aggression that has caused harm to millions of citizens: the dead and their families, people with disabilities due to the hostilities, internally displaced persons, children who have lost their parents, and those who have been subjected to violence. In such circumstances, it is extremely important that support for victims begins as soon as information about them is recorded. To this end, the state policy should be aimed at promptly identifying victims, assessing their needs, and providing them with appropriate social support, assistance, and rehabilitation.
To this end, the Ministry of Social Policy is implementing the Harm Record Information System, with the main areas of work being as follows:
- registering people whose lives and health were damaged as a result of the armed aggression of the russian federation against Ukraine;
- collection and consolidation of information on the affected citizens and further assistance in verifying the data on the damage caused;
- accounting of expenditures of state and local budgets, budgets of social funds related to the provision of assistance and support to citizens affected by the war.
The key principle of the changes is to ensure exchanges between various state registers and databases to facilitate information collection and minimize the bureaucratic burden on the affected person. This will allow the damage to be recorded as quickly as possible. In the future, it is also planned to introduce the possibility for a person to report the damage caused to them through Diia and CASPs. In the future, every victim will have the opportunity to receive a complete dossier on the damage and the types of support available to them through a single window.
The Harm Record Information System is only the first tool to build an effective support system for citizens whose personal non-property rights have been harmed. The next step will be the development and adoption of a comprehensive law on measures to support victims, which the Ministry of Social Policy has already begun drafting. The implementation of the Record System will then allow us to build an effective framework for supporting victims.
