Today, October 8, 2022, the Government of Ukraine has adopted a Resolution of Ukraine "Certain issues of implementation of measures to facilitate the protection of intellectual property rights and registration in the Customs Register of objects of intellectual property rights that are protected in accordance with the law", developed by the Ministry of Finance of Ukraine together with the State Customs Service of Ukraine.
The adopted resolution is aimed to address the issue of termination of promotion of the protection of objects of IPR due to russian aggression. Namely: the registration of objects of intellectual property rights in the Customs Register of objects of intellectual property rights, which are protected in accordance with the law at the request of the right holders (their authorized representatives) is terminated regarding the following categories:
- citizens of the russian federation, legal entities established and registered in accordance with the legislation of the russian federation and/or whose ultimate beneficial owner are citizens of the russian federation or other legal entities created and registered in accordance with the legislation of the russian federation;
- if the producers, exporters or importers of goods containing objects of intellectual property rights are the persons mentioned above.
In addition, there has been settled the issue of suspending the registration of objects of intellectual property rights in the Register at the request of the right holders (their authorized representatives) of individuals and/or legal entities to whom personal special economic and other restrictive measures (sanctions) have been applied in accordance with the Law of Ukraine “On Sanctions”.
