  • Government adopts resolution to prevent improper use of land occupied by the Kakhovka Reservoir

    The Cabinet of Ministers of Ukraine adopted Resolution No. 286 dated 12 March 2024 "On Prevention of Improper Use of Land Occupied by the Kakhovka Reservoir", developed by the StateGeoCadastre. The Resolution entered into force on 16 March 2024.

    The Resolution stipulates that for the period of martial law and for five years after its termination or cancellation, it is prohibited to form, transfer into ownership or use and change the designated purpose of land plots occupied by the Kakhovka Reservoir, except for transfer into use, change of designated purpose of land plots for the purpose of further restoration of the Kakhovka Reservoir and construction of hydraulic structures.

    Within six months from the date of entry into force of this resolution, the StateGeoCadastre shall ensure the creation and mapping of the State Land Cadastre in the form of an information layer on the land occupied by the Kakhovka Reservoir.

    Executive authorities and local self-government bodies, when making decisions on the transfer of land plots into ownership or use, and state cadastral registrars, when making decisions on making data (changes to them) on objects of the State Land Cadastre, should take into account the data of the information layer.

    Control over compliance with the requirements of the Resolution will be carried out in accordance with the procedure established by the Law of Ukraine "On State Control over Land Tenure and Protection of Land", by state inspectors in the field of state control over land use and protection working with the StateGeoCadastre or executive bodies of rural, settlement and city councils, if the relevant council decides to exercise state control over land use and protection.
