  • Deregulation: The law establishing a transparent and modern system of subsoil use came into force

    On March 28, the Law of Ukraine "On Amendments to Certain Legislative Acts of Ukraine on Improving Legislation in the Field of Subsoil Use" No. 2805-IX dated December 1, 2022, came into force. In particular, a number of decisions that formed the basis of this Law were made within the framework of the Interagency Working Group (IWG) on Accelerated Review of State Regulation of Economic Activity.

    "Ukraine is actively deregulating its economy to create favorable business conditions, reduce the administrative burden on entrepreneurs and de-shadow the economy. The new law creates a convenient and transparent system of subsoil use by abolishing outdated and irrelevant regulatory instruments. This decision will help to attract investment and develop the subsoil use industry," commented Yuliia Svyrydenko, First Deputy Prime Minister and Minister of Economy of Ukraine, Co-Chair of the IWG on Deregulation.

    In particular, the law abolishes:

    • the need to obtain approval for subsoil use from regional, Kyiv and Sevastopol city councils;
    • the need to obtain approval for subsoil use from village, town, city, district councils and councils of united territorial communities;
    • the need to obtain the approval of the Ministry of Environmental Protection and Nature Resources to provide subsoil for use without an auction;
    • the need to coordinate the provision of subsoil for use for the extraction of groundwater (except for mineral water) and the development of peat deposits with the State Labor Service and the State Service of Ukraine for Food Safety and Consumer Protection;
    • the need to approve a project for the development of a mineral deposit and processing of mineral raw materials with the State Service on Geology and Mineral Resources;
    • the need to approve the plan for the development of mineral deposits and processing of mineral raw materials with the State Service on Geology and Mineral Resources;
    • the need to obtain annual approval of the company's mining development plan from the State Labor Service;
    • the need to obtain an Act on the provision of a mining area for the purpose of extracting minerals of local importance;
    • the need to coordinate the provision of a land plot during the design of mining facilities.

    "From now on, entrepreneurs no longer need to prepare dozens of documents and obtain burdensome approvals in order to obtain a special permit for subsoil use. This process has been simplified to the maximum extent possible, which will allow the industry to operate and meet the country's needs with its own mineral production," added Yuliia Svyrydenko.
