The Council of National Security
and Defense of Ukraine was established by the
Presidential Decree in 1992 as an advisory deliberative body of the system
of government authorities under the President of Ukraine. By this way it
existed till 1994 until it obtained again according to the Presidential
Decree functions of coordination organizational activity. Grant of
coordination authorities and simultaneously undertaking measures on
adequate information supply enabled the Council and its staff to act much
more effectively, to broach serious subjects of the state. At the same
time it faced restrictions as far as the status of the Council was
determined by Presidential Decrees while its activity influenced on the
activity of the President of Ukraine, Government, defence
structures etc., and required constitutional and legislative approval.
Signing of a Constitutional agreement in 1995 between the Verkhovna Rada and the
President of Ukraine was the first attempt adequately to determine the
status of the Council of National Security and Defense and its position
in the system of state bodies of Ukraine according to which, functions of
a Guarantor of National Security and Defense of Ukraine and a Head of the
Council of National Security and Defense of Ukraine was invested on the
President of Ukraine. In 1996 the Constitution of Ukraine studied this
issue in detail. Firstly, it established a new state authority – the
Council of National Security and Defense of Ukraine that inherited the
functions of former Council of Defense and Council of National Security.
Secondly, the Constitution determined the principle tasks of this authority
– coordination and control of government authorities in the sphere of
national security and defense. Thirdly, the Constitution directly
determined the principle basis of the CNSDU and contained a direct
instruction on special law drafting that would define functions and
authorities of the Council. Thus, at the present moment the Council of
National Security and Defense of Ukraine is a specialized state authority
with constitutional status which is an integral part of the presidential
power and is supposed to ensure one of the most important constitutional
functions of the President – state independence and national security of
the state.

The President of Ukraine chairs
the Council of National Security and Defense of Ukraine. The members of
the Council: Chairman of the Verkhovna Rada of Ukraine (in consent); Prime Minister of
Ukraine; Secretary of the Council of National Security and Defense of
Ukraine; Minister of Emergencies and Affairs of Population Protection
from Consequences of Chornobyl Catastrophe;
Minister for Foreign Affairs of Ukraine; Minister of Defense of Ukraine;
Head of Presidential Administration; Minister of Finance of Ukraine; Head
of the Committee on Frontier Security of Ukraine – Commander of Border
Guard Troops of Ukraine; President of the National Academy of Science of
Ukraine; Head of Security Service of Ukraine; Minister of Internal
Affairs of Ukraine; Minister of Justice of Ukraine; Head of General Staff
of Armed Forces of Ukraine – the first Deputy of the Minister of Defense
of Ukraine; Minister of Economy of Ukraine.

The structure of the Council
of National Security and Defense comprises the: Staff of the Council of National
Security and Defense of Ukraine; National Institute on international
security under the Council of National Security and Defense of Ukraine;
Ukrainian Research Institute of environment and resources under the
Council of National Security and Defense of Ukraine.

Tasks

|
The principles and
tasks of the CNSDU activity are determined by the Law of Ukraine “On
Council of National Security and Defense of Ukraine” of 1998 and the
Concept (basis of public policy) of National Security and Defense of
Ukraine, ratified by the Verkhovna Rada of Ukraine in 1997. The Law defines functions
and authorities of the Council in peaceful time as well as at wartime,
its membership and structure, order functioning, members’ functions etc.. The Concept covers those spheres of vital activity
of the society that are under influence of the national security policy

The activity of the Council of National Security and Defense of
Ukraine is regulated by the Constitution of Ukraine, the Law of Ukraine
on Council of National Security and Defense of Ukraine, Presidential
Decrees and Ukrainian Laws
